Donald Trump was hit with a major setback on Tuesday when a second federal judge barred his administration from ending the Barack Obama-era DACA program next month.

Fox News reported that U.S. District Judge Nicholas Garaufis in New York just ruled that Attorney General Jeff Sessions had “erred in concluding that DACA is unconstitutional” and granted a preliminary injunction sought by state attorneys general and immigrants who had sued the administration. This comes just one month after U.S. District Judge William Alsup in San Francisco ruled that DACA must remain in place while any litigation surrounding it is ongoing.

Now, the U.S. Supreme Court is considering whether to take up the Trump administration’s appeal of this ruling. President Trump has continued to push for DACA to be brought to an end.

“We’re asking Congress to support our immigration policy that keeps terrorists, drug dealers, criminals and gang members out of our country. We want them out. We don’t want them in and right now we’re working on DACA, we’re working on immigration bills and we’re making them tough,” Trump said.

Trump elaborated further on DACA in a Twitter post on Tuesday:

“Negotiations on DACA have begun. Republicans want to make a deal and Democrats say they want to make a deal,” Trump wrote, according to Politico. “Wouldn’t it be great if we could finally, after so many years, solve the DACA puzzle. This will be our last chance, there will never be another opportunity! March 5th.”

Trump has previously made it clear that Democrats must give him what he wants with his border wall if they want him to be lenient in a DACA deal.

“Any deal on DACA that does not include STRONG border security and the desperately needed WALL is a total waste of time,” Trump wrote on Twitter earlier this week.
